These Local Deviations apply, together with the “TIER IV Privacy Policy” (the “Policy”), to the processing of personal information relating to residents of the United States. In the event of any inconsistency or conflict between these Local Deviations and the Policy, these Local Deviations prevail to the extent required by applicable law. California residents should also refer to the separately published “California Privacy Notice”, depending on their relationship with the Covered Companies.

Where Tier IV North America Inc. provides business contact information obtained from partners or prospective customers to TIER IV, Inc. and TIER IV, Inc. uses that information for customer acquisition, communications and similar purposes, the role of each company is likewise determined by reference to which entity substantively determines the purposes and essential means, the discretion over the collection and use of the information, instruction relationships and other actual circumstances of the processing, and applicable law.
